PRIVACY POLICY

  1. UAB “Retiva” (hereinafter – the Company or Retiva) respects and understands the special importance of the protection of your personal data, therefore it collects and processes only those data of yours that are necessary for the performance of the Company’s activities. Personal data is processed legally, transparently and fairly, for predetermined purposes and only to the extent necessary to achieve the purposes. When processing personal data, we strive to keep it accurate, secure, confidential, properly stored and protected.
  2. When processing your personal data, we comply with the General Personal Data Protection Regulation (hereinafter – GDPR), the Law on the Legal Protection of Personal Data of the Republic of Lithuania (hereinafter – ADTAĮ), the Law of the Republic of Lithuania on Electronic Communications (hereinafter – ERĮ) and other directly applicable legal acts regulating personal data protection, regulations.
  3. When processing personal data, the following GDPR principles are followed: purpose limitation (Data processing only for the purpose that was originally specified); reducing the amount of data (only as much Personal Data as necessary); legality, fairness and transparency; accuracy; limitation of storage duration (stored only as long as necessary for a specific purpose); the principle of integrity and confidentiality and accountability (the Manager provides evidence regarding the performance of his duties).
  4. The privacy policy applies to all persons whose data is processed by Retiva.

CONCEPTS

  1. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons in the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.   2. Personal data – any information about an identified or identifiable natural person (data subject); an identifiable natural person is a person whose identity can be determined directly or indirectly, in particular by an identifier such as a name, a personal identification number, location data and an Internet identifier, or by one or more of that natural person’s physical, signs of physiological, genetic, mental, economic, cultural or social identity.
  3. Person – any natural person whose Personal Data is processed (data subject), e.g. can be a Potential Candidate, Candidate, Temporary Employee, Administrative Employee or any other natural person.
  4. Policy – Personal data processing policy of the office group of companies.
  5. Data Recipient – a natural or legal person, government authority, agency or other body to which personal data is disclosed, whether or not it is a third party.
  6. Data subject – a natural person whose personal data is collected on the Portal.
  7. Provision of data – disclosure of personal data by transmission or otherwise making them available (except for publication in public information media).
  8. Data processing – any operation or sequence of operations performed by automated or non-automated means on personal data or sets of personal data, such as collection, recording, sorting, systematization, storage, adaptation or modification, extraction, familiarization, use, disclosure by transmission, distribution or otherwise making it possible to use them, as well as juxtaposition or combination with other data, restriction, deletion or destruction.
  9. Data processor – a natural or legal person, public authority, agency or other institution that processes personal data on behalf of the data controller.
  10. The data controller is UAB “Retiva”, a company established in accordance with the laws of the Republic of Lithuania, code 304850497, registered office at Tilžės st. 116, Šiauliai, LT-77160, Republic of Lithuania , data on which are collected and stored in the Register of Legal Entities.

COLLECTION OF PERSONAL DATA

  1. We process your personal data received in the following ways:
  • When you submit them to us. You provide us with your personal data when you send us your CV, motivational letters, apply for our job advertisements on job search portals, register on our websites, communicate with us by phone, e-mail. by mail or during meetings, you answer questionnaires provided by us, perform tasks or tests, contact us via social networks (e.g. Facebook, Linkedin), using the Facebook manager chat program integrated on the website, share your success stories and provide feedback about us. If you contact us in writing or electronically, we will save the correspondence data.
  • When you use websites operated by us, certain information (e.g. Internet address (IP), device used, Internet browser used, number of visits, pages of our website viewed, time spent on the website, websites you visited before accessing to our website) is collected automatically.
  • When we receive your personal data from other persons in accordance with the procedure established by legal acts and/or this Privacy Policy.
  1. We can combine personal data received from you with data collected by us from other public or accessible sources. For example, we can combine the personal data you provide with data obtained using website cookies, data collected by you when providing our services, or with data legally obtained from third parties. By exercising your rights, you can always demand the correction of incorrect personal data.
  2. In exceptional cases, if special categories of Personal Data are processed, such as information about criminal records, health, trade union membership, etc., the administrative staff additionally checks whether all necessary actions have been performed and performs additional actions (e.g. obtains separate consent for processing) and takes measures (e.g. not to save in the Manager’s database or in the programs used) when necessary.

PURPOSES AND BASIS OF PROCESSING PERSONAL DATA

  1. Your personal data is processed in accordance with the following basic principles of personal data processing established by GDPR:
  • In order to fulfill a contract or to take action at the request of a data subject before entering into a contract;
  • With the consent of the data subject;
  • When processing data is necessary to fulfill a legal obligation to which we are subject;
  • When personal data needs to be processed for our or a third party’s legitimate interests.
  1. We process your personal data for the following purposes:
  • For the purpose of providing services. We process your personal data in order to provide our services to you and other persons: to find and select candidates who meet the needs of our customers, to assess whether candidates are suitable for the job offered, and to present candidates to employers or employ them in our company.

For this purpose, we process your personal data received from you yourself (e.g. data provided in your CV, data collected during communication and other data necessary for processing), collected by you using our and other websites and/or received from other persons (e.g. ., recommendations from current or former employers or acquaintances, social networks, public information tools, etc.).

For this purpose, we provide or transfer your data to our partners and clients – employers who are looking for employees. Together with us, they will be the controllers of your personal data. We will not transfer more of your personal data to customers than we will process on the basis of this Privacy Policy. We have signed contracts with our clients, in which both parties undertake to protect your personal data.

For this purpose, we process your data while the service is provided to you. If your personal data is processed by providing services to other persons, after receiving your consent, we process your personal data for 3 years after receiving your consent.

When providing services, after receiving your consent, we can carry out your (candidate’s) evaluations and testing and film evaluations and tests. Videos, results of evaluations/tests can be transferred to our client who has applied for the execution of a specific selection.

You have the right to view the videos related to you, the results of tests and assessments, to request that the video be recorded on a digital medium.

We will process the video recordings, testing, and evaluation results while a specific selection is being carried out or, after obtaining your consent, for the purpose of administering the candidate database, for a longer period than specified in this Privacy Policy. If we determine that there is reason to believe that the video captures a crime or other illegal activity or an internal investigation is initiated, the video will be preserved until the conclusion of the relevant investigation and/or trial.

  • For the purpose of administering the candidate database. At the end of the specific selection to which you submitted your data, after receiving your consent, we process your personal data in order to be able to offer you work and career opportunities in the future, to find and select candidates who meet the needs of our customers, to assess whether the candidates are suitable for the job offered, and introduce candidates to employers.

For this purpose, we process the same personal data as for the purpose of providing services, provide them to the same persons and store them for 3 years after receiving your consent.

  • We also process the data of the person you recommend for the purpose of selection for the workplace offered by us or our partners, and the data of your (recommending) person – for the purpose of administering the bonus for the recommended person. 

For this purpose, we process the following data of the recommended person: name, surname, telephone number, e-mail address. postal address, work experience, qualities, talents, other information provided; data of the recommending person: first name, last name, phone number, e-mail e-mail address, data necessary for bonus payment, e-mail the IP address of the mail sender’s server, the device from which the e-mail was sent email IP address, data source (from where the data was obtained, name of the source, date of data acquisition, person who entered the data).

We will process the data of the recommended person for 3 years from the date of consent. We will process the recommender’s data during the selection process of the recommended person (if the recommended person will not be employed) or for 3 years after the payment of the bonus (if the recommended person will be employed).

Retiva may transfer the data of the recommended person specified by you for the purpose of selection for the workplace offered by Retiva and/or its partners to potential employers around the world, including those in countries whose legal acts do not ensure the level of legal protection of personal data valid in Lithuania. When transferring personal data to a recipient in such a country, Retiva and the recipient of personal data will apply appropriate security measures to protect personal data from unlawful processing. We may also transfer the personal data specified in the consent to a third party providing services to Retiva, including to legal, tax, business or personnel administration, accounting advisers and competent state institutions in accordance with the procedure established by law.

  • For the purpose of quality control of services (recording of telephone conversations). When you call us or we contact you, we record our conversation in order to ensure the quality of service and control the provision of services.

For this purpose, we process your personal data: name, surname, telephone number; record of the telephone conversation (data provided during the conversation), date and time of the telephone conversation, name of the person advising you;

For this purpose, we receive your personal data from you or create it for you using our services.

For this purpose, we store your data for 1 year.

  • In order to administer the work activities of employees. To the extent that we are obliged or permitted to do so by legal acts, we process the personal data of our employees in accordance with the procedure established by our internal rules.
  • For the purpose of improving the managed websites and in order to offer you better and customized services. We use your personal data, including the personal data we receive when you use our websites, in order to improve and develop these websites and offer you better and more customized services. For this purpose, we use your personal data received from you, received by you using our websites and received from other persons.
  • For direct marketing purposes. After receiving your consent and in order to offer you our services, those related to us and our partners, and to improve our services, we process your personal data.

When your personal data is processed after you have given your consent, after you withdraw your consent or after the expiry of the validity period of your consent, your personal data will no longer be processed, with the exception of the storage of data confirming the fact of giving consent for no longer than 10 (ten) years in order to assert, fulfill or defend our legal claims .
  2. We do not process your personal data for any other purposes incompatible with the purposes listed above.

PROCESSING OF PERSONAL DATA FOR DIRECT MARKETING PURPOSES

  1. After receiving your additional consent and in accordance with the provisions of ADTAĮ and ERĮ, we can use your personal data for the purpose of direct marketing in order to provide you with offers and information about our products and/or services of our related persons and partners, which, in our opinion, could be Useful for you.

  1. Retiva uses cookies and other identification technologies in its programs, websites, e-mails and online advertisements.

  • Demand that the Company delete personal data related to you, if:
    • they are no longer necessary to achieve the purposes for which they were collected or otherwise processed;
    • you withdraw your consent and there is no other legal basis for processing your personal data;
    • personal data were processed illegally;
    • on other grounds established in the Regulation.
  • Demand that the Company restricts the processing of your personal data when:
    • you dispute the accuracy of the data for a period during which the data controller can verify the accuracy of the data;
    • the processing of personal data is illegal and you do not consent to the deletion of the data;
    • The Company no longer needs the personal data for processing purposes, but you need it to assert, enforce or defend legal claims;
    • you have objected to the processing of your personal data until it is verified whether the Company’s legitimate reasons override your reasons.
  • Receive the personal data relating to you that you have provided to the Company in a structured, commonly used and computer readable format.
  • Do not consent to the processing of your personal data.
  • We will try to guarantee the implementation of your rights as a subject of personal data and create all the conditions for the effective implementation of these rights, but we reserve the right not to fulfill your requirements when it is necessary to ensure:
    • performance of legal obligations imposed on us;
    • national security or defense;
    • public order, prevention, investigation, detection or prosecution of criminal acts;
    • important economic or financial interests of the state;
    • prevention, investigation and determination of violations of official or professional ethics;
    • Protection of your or other persons’ rights and freedoms.
  • You can submit requirements related to the exercise of your rights to us in person, by mail or by electronic means of communication. After receiving your application, we may ask you to provide proof of identity, as well as other additional information we need related to the application.
  • Upon receipt of your request, we will respond to you no later than within 30 calendar days from the date of receipt of your request and submission of all documents required for the response.
  • If we deem it necessary, we will stop processing your data, except for storage, until your request is resolved. If you legally withdraw your consent, we will immediately, but no later than 30 calendar days, stop processing your personal data, except for Section 7 1.8 of this Privacy Policy. point and the cases established by legal acts, i.e. when we are required to continue processing your data by valid legal acts, legal obligations falling on us, court decisions or mandatory instructions given to us by authorities.

PROVISION OF PERSONAL DATA

  1. We guarantee that your personal data will not be sold, provided or otherwise transferred to third parties without a legal basis, as well as used for purposes other than those for which they were collected. We will not transfer your personal data in any way other than in accordance with this Privacy Policy and legal acts. However, we reserve the right to provide information about you if we are required to do so in accordance with the law or if we are required to do so by legally operating authorities or criminal prosecution authorities.
  2. We can transfer your personal data to companies belonging to the Headex group, as well as to companies that help us carry out our activities (partners, customers, suppliers). From such partners, we require that your data be processed only in accordance with the instructions given by us and valid legal acts ensuring the protection of your data. We enter into contracts with these persons, which oblige the parties to strictly comply with the requirements for personal data protection.
  3. The above-mentioned service providers’ ability to use your data is limited – they cannot use this data for purposes other than providing services to us.
  4. An incomplete list of persons and their categories to whom we transfer your personal data is presented in point 2.2 of this Privacy Policy separately for each purpose of using personal data.

STORAGE OF PERSONAL DATA

  1. We store your personal data for no longer than is required by the purposes of data processing or provided for by legal acts, if a longer data retention period is set in them.
  2. We strive not to store outdated, out-of-date personal data, so when they are updated (e.g., by clarifying the account, changing information, etc.), only relevant information is stored. Historical information is stored if it is necessary in accordance with the procedure established by legislation or to carry out our activities.
  3. In point 2.2 of the privacy policy, the storage terms of your personal data are specified separately for each purpose of using personal data.
  4. The data we collect from you will be in the territory of the European Union, but may be transferred or stored outside the EU. They may also be processed by our or our suppliers’ personnel based outside the EU. When transferring your data outside the EU, we will take all necessary steps to ensure that your data is handled securely and in accordance with this privacy policy.

PRIVACY POLICY CHANGES

  1. Retiva may change this Privacy Policy at any time in its sole discretion. We note that after changes to the Privacy Policy, the implementation of such changes may take up to 30 working days. If you want to follow changes to the Privacy Policy, periodically check this section of the Portal.
